From advertising allegations to consumer payments
The FTC challenged Volkswagen’s promotion of affected diesel vehicles as environmentally friendly. The consumer case concerned the representations made to purchasers and lessees, alongside separate governmental proceedings over emissions and environmental consequences. [1; 2]
Court-approved settlements created consumer remedies that included buybacks or early lease termination and, where applicable, approved modifications with compensation. In July 2020 the FTC reported that more than $9.5 billion had been returned to consumers. That figure described reported consumer redress, not a single civil fine payable to the government. [1; 2]
What the final report establishes
The FTC explained that compensation addressed more than the vehicles’ value: the settlements also accounted for specified losses associated with the deception. Administration took place under court supervision, including an independent claims supervisor monitoring compliance. [2]
The report provides evidence of implementation, which is different from announcing a proposed settlement ceiling. It should not be read as a total for every worldwide Volkswagen proceeding. The FTC expressly distinguished additional environmental relief obtained by the Department of Justice and the Environmental Protection Agency. [2]
